Welcome to Analytic Call Tracking. These Terms of Service (“Terms”) govern your access to and use of the inbound call-tracking, recording, messaging, and analytics software and related services (the “Service”) provided by Analytic Call Tracking (“we,” “us,” or “our”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

1.1. You must be at least 18 years old and able to form a binding contract to use the Service.

1.2. You are responsible for the accuracy of your account information and for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account.

1.3. You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.

2. The Service

2.1. The Service lets you provision tracking phone numbers, route and record inbound calls, send and receive business text messages, build call flows, and report on call activity and marketing attribution.

2.2. Your use may be subject to plan limits, including included call volume, call flows, number of tracking numbers, and call-history retention. Usage beyond included amounts may incur additional fees.

2.3. We may modify, improve, suspend, or discontinue features of the Service. We will use reasonable efforts to notify customers of material changes.

3. Call Recording, Messaging, and Compliance

3.1. The Service can record calls, capture voicemail and transcriptions, and send text messages. Laws governing call recording, monitoring, and electronic messaging — including consent requirements, the TCPA, and similar regulations — vary by jurisdiction.

3.2. You are solely responsible for using the Service in compliance with these laws, including obtaining any required consent before recording or monitoring calls or sending messages, and for honoring opt-out and do-not-call requests. You agree to configure appropriate greetings, disclosures, and consent mechanisms where required.

3.3. You will not use the Service to send unlawful, harassing, deceptive, or unsolicited communications, or to engage in fraud, spam, or robocalling in violation of applicable law.

4. Acceptable Use

4.1. You agree not to: (a) interfere with or disrupt the Service; (b) attempt to gain unauthorized access to any system or data; (c) resell or provide access to the Service except as expressly permitted by your plan; (d) use the Service to violate the rights of others; or (e) use the Service in a manner that imposes an unreasonable load on our infrastructure.

5. Customer Data and Privacy

5.1. As between you and us, you retain ownership of the call, message, and attribution data collected through your account (“Customer Data”). You grant us the rights necessary to host, process, and transmit Customer Data to provide the Service.

5.2. You represent that you have all rights and consents needed to collect and process Customer Data, including data about callers and texters. Our handling of personal information is described in our Privacy Policy.

5.3. We may use aggregated, de-identified data to operate and improve the Service.

6. Fees and Payment

6.1. Paid plans require payment of the applicable subscription fees plus usage-based charges (such as per-minute, per-number, and recording-storage fees). By subscribing, you authorize us to charge your payment method on a recurring basis.

6.2. Except where required by law or expressly stated, fees are non-refundable. We may change fees with advance notice; changes apply to subsequent billing periods.

6.3. Failure to pay may result in suspension or termination of the Service.

7. Intellectual Property

7.1. The Service, including its software, design, trademarks, and content (excluding Customer Data), is owned by Analytic Call Tracking or its licensors and is protected by intellectual property laws.

7.2. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, reverse engineer, or distribute the Service except as permitted by law.

8. Third-Party Services

The Service integrates with third-party platforms (such as Google Ads, Microsoft Ads, Zapier, and telecommunications carriers). Your use of those services is governed by their own terms, and we are not responsible for their performance or practices.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that call routing and delivery will be free of delays or failures inherent to telecommunications networks.

10. Limitation of Liability

To the maximum extent permitted by law, Analytic Call Tracking and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from or related to your use of the Service. Our aggregate liability for any claim will not exceed the amount you paid us for the Service in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Analytic Call Tracking from claims, damages, and expenses arising out of your use of the Service, your Customer Data, or your violation of these Terms or applicable law, including call recording and messaging laws.

12. Termination

12.1. You may cancel your account at any time through your account settings.

12.2. We may suspend or terminate your access for violation of these Terms, non-payment, or unlawful use. Upon termination, your right to use the Service ends, and we may delete Customer Data after a reasonable period.

13. Governing Law and Changes

13.1. These Terms are governed by the laws of the jurisdiction in which Analytic Call Tracking is established, without regard to conflict-of-laws principles.

13.2. We may update these Terms from time to time. We will revise the “Last updated” date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.
